These terms govern car rental and tour services provided by GSK Service & Tour Sdn Bhd (“GSK”, “we”, “us”), and your use of our website and online booking channels. By making a booking or taking a vehicle, you accept these terms.

When you collect a vehicle you also sign our Surat Perjanjian Terma & Syarat Sewa Kereta (the rental agreement). These terms and that agreement are meant to say the same thing; if they ever differ, the signed rental agreement prevails for that rental.

2. Who may rent and drive

• You must hold a valid Malaysian Class D driving licence that has not expired.
• You must be physically fit and of sound mind to drive.
• You must attend in person at collection to sign the rental agreement.
• Only drivers named and documented in the agreement may drive. Lending or sub-letting the vehicle to anyone else is strictly prohibited.

Documents required

• A copy of the renter’s MyKad (front and back).
• A copy of the renter’s driving licence (front and back), valid and unexpired.
• If more than one person will drive, the licence and MyKad of every additional driver.
• A reference: the MyKad of a spouse or close relative, plus an original utility bill (for example TNB or Astro) or student card to confirm your address.

If we do not receive the required documents within 24 hours of a booking, we may cancel it, and the booking fee is not refunded.

3. Booking, payment, and deposit

• A booking is confirmed only once we receive the booking fee. The full rental charge and the security deposit must be settled before or at collection.
• Payment is by online banking or QR Pay (DuitNow) only. We do not accept cash on delivery, e-wallet transfers, or Cash Deposit Machine payments for any transaction.
• The security deposit is RM100 or RM300, depending on the vehicle and the rental period.
• We refund the deposit within 7 to 14 working days after the vehicle is returned, provided it comes back in good condition and free of any summons or compound.

4. Rental period, collection, and delivery

• Minimum rental: 24 hours on weekdays (Klang Valley area) and 48 hours at weekends. Different minimums may apply during Hari Raya Aidilfitri, Aidiladha, and other public holidays.
• Collection at our Bangi office: daily, Monday to Sunday, 9:00 am – 10:00 pm. Collection after 10:00 pm is subject to an after-hours charge.
• Delivery to your location: Monday to Friday, 10:00 am – 5:00 pm only (KLIA and special locations by arrangement).
• Delivery and collection charges depend on your location and require a minimum three-day rental. Delivery is free only for selected locations near our Bangi office.

5. Cancellations and date changes

• The booking fee is refundable only if you cancel at least 14 days before the rental date.
• Changes to a booking date can only be made within the 14 days before the rental date.
• If you attend in person but the rental cannot proceed because the conditions in section 2 are not met, the deposit paid is forfeited.

6. Late return and extensions

Late return is charged for each hour beyond the agreed return time, at a minimum of:

• To extend a rental you must pay immediately, by online banking or QR Pay, before the current rental period ends.
• If payment for an extension is not received, we will not extend the rental, and the vehicle’s engine immobiliser may be activated at any time, stopping the vehicle.
• We may also recover the vehicle. Where we do, you may be charged a recovery fee in addition to the outstanding rental.

7. Rules while renting

During the rental period you must not:

• use the vehicle for any criminal act or activity that breaks Malaysian law;
• modify or alter the vehicle in any way;
• carry strongly-smelling items such as durian or cempedak;
• sub-let or lend the vehicle to any other person;
• smoke inside the vehicle;
• drive the vehicle outside Peninsular Malaysia.

Breaking any of these rules results in forfeiture of the deposit, in addition to any other charges properly due.

8. Summonses, compounds, and traffic offences

• You are fully responsible for every PDRM, JPJ, or local council summons or compound issued during your rental period.
• We will notify you of the amount, and you pay it to us.
• We may claim payment at any time after a summons is issued or updated by the authorities, even after your deposit has been returned, so that the vehicle’s record stays clear.

9. Breakdown, accident, and damage

Tell us immediately if the vehicle breaks down, is damaged, or is involved in an accident. Call [emergency phone number].

• Technical faults such as a flat battery or overheating radiator: we will replace the vehicle with another available one, or send a panel workshop representative to repair it.
• Damage below RM5,000: we will claim the repair cost from you.
• Damage of RM5,000 or more: we will claim through our insurer, and you reimburse the current value of the lost No-Claim Discount (NCD), plus rental income lost while the vehicle is in the workshop, charged pro rata.
• General damage is charged from a minimum of RM50 up to a maximum of RM20,000, depending on the type and extent. We may also claim income lost because the vehicle could not be rented.
• If the vehicle is lost, not recovered, or seriously damaged, you are responsible for all costs of restoring us to our original position.
• In an accident you must lodge a police report as required by Malaysian law and give us a copy. Do not admit liability or settle with another party on our behalf, and do not arrange repairs without our written approval.

Before driving away, you may ask us for a recording of the vehicle’s condition, or record it yourself. We recommend doing so — it protects both of us if a dispute about new damage arises later.

10. Outstanding payments

Any outstanding rental, damage, or summons amount is payable immediately. If it remains unpaid, we may begin legal proceedings after 30 days. Where we take legal action, all legal and court costs are borne by the renter.

11. Our responsibilities

We supply vehicles that are roadworthy, taxed, and insured, and serviced according to the manufacturer’s schedule. If we cannot supply the vehicle you booked and cannot offer an acceptable alternative, we refund what you have paid for the unfulfilled part of the booking. We are not responsible for indirect losses such as missed flights or appointments, or for personal belongings left in a vehicle, except where the loss is caused by our negligence or liability cannot be excluded under Malaysian law.

12. Tour services

Where we provide a tour, driver, or transfer, the itinerary, inclusions, and price are those set out in the confirmation we send you. Timings depend on traffic, weather, and road conditions, and we may vary an itinerary where safety requires it.

13. Our website and social media

• Text, photographs, logos, and vehicle images on our website and social media pages belong to us or our licensors and may not be copied for commercial use without permission.
• You may not attempt to disrupt, probe, or gain unauthorised access to our systems.
• When you comment on or message our pages we may reply publicly or privately, and may hide or remove comments that are abusive, misleading, or unlawful.
• How we handle personal data is set out in our Privacy Policy.

14. Changes to these terms

We may update these terms; the date at the top shows when they last changed. The version in force when you book is the version that applies to that booking.

15. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute. We would rather settle any complaint directly first — write to gskservice.tour@gmail.com.
